TERMS AND CONDITIONS

1. INTRODUCTION

Welcome to ProDrive Academy (“Company,” “we,” “our,” “us”). By accessing or using our website (www.prodrive-academy.com) and services, including but not limited to driving lessons, driving tests, defensive driving courses, and other related training programs, you (“User,” “Student,” “Client”) agree to comply with and be bound by these Terms and Conditions. If you do not agree with these Terms, please do not use our services.

2. ELIGIBILITY

2.1. Age Requirement: To enroll in ProDrive Academy’s driving courses, you must be at least 15½ years old with a valid Learner’s Permit (for minors) or meet state-mandated driving age requirements.

2.2. Legal Compliance: You agree to comply with all applicable federal, state, and local driving laws while using our services.

2.3. Accurate Information: You must provide accurate, current, and complete personal information when registering for our courses. Failure to do so may result in denial of services.

3. DRIVING LESSONS & TESTING POLICIES

3.1 Enrollment & Fees

  • All driving course fees must be paid in full before the first scheduled lesson.
  • Payment confirms your reservation but does not guarantee a license—students must pass all required assessments.
  • Fees are non-refundable, except as outlined in Section 8 (Refund & Cancellation Policy).

3.2 Scheduling & Attendance

  • Lessons must be scheduled in advance and are subject to instructor availability.
  • Students must arrive at least 10 minutes before the lesson starts.
  • If you arrive more than 15 minutes late, the lesson may be canceled without a refund.

3.3 Safety Requirements

  • Students must wear proper footwear (no flip-flops or high heels).
  • Any reckless or dangerous behavior will result in immediate termination of the lesson without a refund.

3.4 Driving Test Policies

  • Students taking the Oklahoma City Driving Test must bring all required documentation, including:
    • A valid Learner’s Permit
    • Proof of completion of driver’s education (if required)
    • Payment receipt for the driving test
  • ProDrive Academy reserves the right to deny testing services if a student does not meet eligibility requirements.

4. PAYMENT & BILLING

4.1. Payment Methods – We accept credit/debit cards, PayPal, and other approved electronic payment methods.

4.2. Late Payments – If you fail to make a timely payment, your account may be suspended or subject to additional administrative fees.

4.3. Chargebacks & Disputes – Any chargeback or payment dispute must be resolved within 7 days of notice. We reserve the right to pursue legal action for fraudulent disputes.

5. LIABILITY WAIVER & INDEMNIFICATION

5.1. Assumption of Risk
By enrolling in ProDrive Academy, you acknowledge that driving instruction carries inherent risks, including but not limited to accidents, collisions, injuries, or property damage. You agree to participate at your own risk.

5.2. Indemnification
You agree to indemnify, defend, and hold harmless ProDrive Academy, its instructors, affiliates, and employees from any claims, damages, or liabilities arising from:

  • Your participation in driving lessons
  • Your use of ProDrive Academy vehicles
  • Your violation of traffic laws

5.3. Insurance Coverage
While using ProDrive Academy vehicles, students are covered under our commercial insurance policy. However, students are responsible for any damages caused by negligent or reckless driving.

6. STUDENT CONDUCT & TERMINATION

6.1. Code of Conduct
Students must:

  • Follow all instructor instructions during lessons.
  • Refrain from using mobile devices while driving.
  • Respect ProDrive Academy staff and other students.

6.2. Grounds for Termination
We reserve the right to terminate services without a refund if a student:

  • Engages in reckless driving or aggressive behavior.
  • Fails to follow instructor directions.
  • Uses drugs or alcohol before or during lessons.

7. REFUND & CANCELLATION POLICY

8. PRIVACY POLICY

Your personal information is handled in accordance with our Privacy Policy, which can be found here.

9. INTELLECTUAL PROPERTY

All content, materials, and training techniques provided by ProDrive Academy are protected under intellectual property laws. Unauthorized use, reproduction, or distribution of our training materials is strictly prohibited.

10. MODIFICATIONS TO TERMS

ProDrive Academy reserves the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting on our website.

11. GOVERNING LAW & DISPUTE RESOLUTION

11.1. Governing Law
These Terms and Conditions are governed by the laws of the State of Oklahoma.

11.2. Dispute Resolution

  • Any disputes shall first be attempted to be resolved informally through direct communication.
  • If a dispute cannot be resolved, it shall be settled through binding arbitration in Oklahoma City, Oklahoma.
